"R-1" RESIDENTIAL DISTRICT

20.00 - Statement of Intent.
The intent hereof is that this district
shall provide uncongested, hazard-free
residential neighborhoods which are
comprised of single-family detached
residences and compatible structures and
uses.
20.01 - Permitted Principal Uses and
Structures.
The following principal uses and
structures shall be permitted in the
"R-1" district:
- Single-family
detached dwelling.
- The growing of
agricultural crops, including the usual
agricultural structures and uses such as
farm dwelling, noncommercial greenhouses,
barns, and the like.
- Public and
private parks and
playgrounds.

Forestry.
- Public buildings
and structures of a recreational or
public service type.
- Public
information or event signs, subject to
the provisions of Section
8.02.
20.02 - Special
Exceptions.
The following principal uses and
structures may be permitted by Special
Exception in the "R-1"
district.
-
Churches.
- The home office
of a doctor of medicine, dentistry, or
psychiatry, provided that the off street
parking requirements of Section 8.00
shall be met.
-
Cemeteries.
- Public or private
schools.
- Public or private
utility structures, other than essential
services, as defined in Section
7.00.
- Nursing
homes.
- Kennels, poultry
houses, livestock barns, and other uses
and structures involving the care or
storage of animals other than household
pets.
- Commercial
greenhouses.
- A residential
structure which is in existence at the
effective date of this ordinance may be
altered to contain as many as three
separate dwelling units so long as the
exterior appearance of the structure is
not, in the judgement of the Zoning
Administrator, significantly changed in
order to accommodate the additional
dwelling units, and so long as all other
legal requirements are met.
- Additional
permitted uses on a conforming or valid
existing non-conforming lot.
20.03 - Accessory Uses and
Structures.
The following accessory uses and
structures shall be permitted in the
"R-1" district:
- Private garages,
parking areas, and other customary
residential outbuildings and
structures.
- Customary
incidental home or farm occupations
providing that all home occupations shall
require a permit from the Town Council.
Such permits shall be for three years,
and may be renewed by the Town
Council.
- Signs advertising
home occupations, subject to the
provisions of Section 8.02.
- Farm signs,
subject to the provisions of Section
8.02.
- Temporary real
estate signs, subject to the provisions
of Section 8.02.
- Temporary
buildings and structures incidental to
construction work which shall be removed
upon completion or abandonment of the
construction work.
- Generally, uses
and structures customarily associated
with and directly incidental to the
permitted principal uses and
structures.
- Uses and
structures customarily associated with
and directly incidental to the uses and
structures permitted by special exception
only after such special exception shall
have been granted by the Board of
Appeals.
The following
provisions shall apply to accessory
structures:
- Accessory
structures shall be located only in rear
yard or side yard, except for signs
allowed herein.
- No accessory
structure exceeding 250 square feet in
floor area or part thereof shall be
located less than 15 feet from any side
or rear lot line.
- No minor
accessory structure or part thereof shall
be located less than three feet from any
side or rear lot line, except that on
corner lots no such structure shall be
located less than fifteen feet from the
edge of the street pavement.
- Only one
structure shall be allowed as a minor
accessory structure on any given lot or
parcel.

20.04 - Height
Regulations.
No building or structure shall exceed 40
feet in height. This height limitation
shall not apply to: roof structures for
housing mechanical equipment or stairways,
fire or parapet walls, towers, steeples,
flag poles, silos, masts, monuments,
cooling towers, grain elevators, or
essential services as defined in Section
7.00, or other utility structures.
20.05 - Area, Width, and Yard

Section 20.06 One

"COMMON REGULATIONS"

26.15 - Fences:
Fences and walls erected in
conformance with this Section shall not be
subject to setback requirements from
property lines. Such fences and walls may
be located in the established yards in any
zoning district, subject to Section 26.01
of this Ordinance, as follows:
- Fences and walls
not exceeding at any point four (4) feet
in height above the elevation of the
surface of the ground, may be looted in
any front yard, but not beyond the
property line. Ornamental front yard
fence gates, finials, or other ornamental
posts shall not exceed four and one half
(4 1/2) feet in height. Fences and walls
erected behind the front yard setback in
any applicable zoning district as set
forth in the Zoning Ordinance shall be
permitted to a height of eight (8) feet
in height above grade.
- Fences and walls
not exceeding at any point eight (8) feet
in height above the elevation of the
surface of the ground, may be located in
any rear yard or side yard
area.
26.16 - Swimming
Pools:
All permanent or semi-permanent swimming
pools shall be fenced or otherwise enclosed
in such a manner as to prevent inadvertent
access to swimming pools. All applications
for building permits for swimming pools
shall include plans for the fence or other
structure to enclose the proposed swimming
pool. Fences used to enclose swimming pools
shall be six (6) feet in height, or the
minimum height established by any state
regulations or the BOCA code, whichever are
greater.
26.17 - Corner Lot Restrictions:
On corner lots, all sides of the lot which
face a street must comply with the
applicable front setback. The sides of the
lot which do not face a street must comply
with applicable side yard setbacks.

"A" - AGRICULTURAL DISTRICT

24.00 - Statement of Intent
The intent hereof is that the
"A" district shall be used to
prevent intense development in outlying
areas which are not served by town water,
sewer, and other services. As an additional
consideration, the "A" district
is intended to help maintain the open,
spacious character of the outlying areas of
town.
24.01 - Permitted Principal Uses and
Structures
The following principal uses and structure
shall be permitted in the "A"
district:
- Public and
private conservation areas,including
wildlife reservations, arboretum
demonstration forests.
- Floodways; flood
prevention, erosion control, or similar
works.
- Fish or game
hatcheries.
- Public and
private parks, and playgrounds for the
purpose of conserving and enjoying the
natural resources.
- Forests,
forestation.
- Hunting and
fishing cabins used only for temporary
residence.
- Agriculture,
including the growing of crops and the
production of livestock or poultry.
Included are the usual agricultural
structures and uses such as farm
dwellings, commercial and noncommercial
greenhouses, barns, poultry houses, and
the like, providing that all poultry
houses, feeder lots, and other uses
involving the intensive handling or
sheltering of animals shall be located at
least 200 feet from any property
line.
- Duck blinds,
goose blinds, and the like.
- Riding stables of
a noncommercial nature.
- Single-family
dwellings, and duplex
dwellings.
- Commercial and
noncommercial hunting and fishing
sites.
- Public buildings
and structures of a recreational,
conservation, cultural or public service
type.
- Signs, including
directional signs advertising a
commercial enterprise and public
information or event signs, subject to
the provisions of Section
8.02.
- Private or church
cemeteries.
24.02 - Special
Exceptions The following principal uses
and structures may be permitted by special
exception in the "A"
district:
- Golf courses,
commercial or private, not lighted for
night play and not including miniature
golf courses or driving ranges. Included
as an accessory use may be a building for
a golf shop, locker room, snack bar, and
other uses incidental to the golf
course.
- Churches,
temples, convents, and
monasteries.
- The home office
of a doctor of medicine, dentistry, or
psychiatry in his residence, provided
that the off street parking requirements
of Section 8.00 shall be met.
- Campgrounds and
travel trailer parks for transient or
seasonal use only, provided that no
building, structure, or campsite shall be
located less than 200 feet from any other
boundary of the tract including the
waterfront boundary.
- Public and
private schools.
- Commercial riding
stables.
- Refuse disposal
sites, subject to the provisions of
Section 8.05.
- Utilities other
than essential services, as defined in
Section 7.00.
- Sewage disposal
plants, provided such plants shall not be
less than 500 feet from any dwelling,
school church, or other structure
intended for human occupancy.
- Mobile homes, and
mobile homes parks subject to the
provisions of Section 8.03.
- Farm labor camps
for temporary occupancy, provided such
camp is located at least 200 feet from
all property lines and occupied by no
more than 20 persons.
- Waste water
irrigation areas where such systems are
approved by the health department and
cause no objectionable odors, fumes,
noises, or other adverse environmental
conditions.
- Additional
permitted uses on a conforming or valid
existing non-conforming lot.
24.03 - Accessory
Uses and Structures
The following accessory uses and
structures shall be permitted in the
"A" district:
- Generally, uses
and structures customarily associated
with and directly incidental to the
permitted principal uses and
structures.
- Permanent
residences for custodial
quarters.
- Living quarters
for persons employed on the
premises.
- Private garages
and parking areas, swimming pools, and
other customary outbuildings and
structures.
- Customary
incidental home or farm occupations
providing that all home occupations shall
require a permit from the Town Council.
Such permits shall be for three years,
and may be renewed by the Town
Council.
- Roadside stands
offering for sale agricultural products
in season, provided that no less than 75
percent of the products offered for sale
are produced on the premises where such
roadside stand is located.
- A guesthouse,
provided that such house is used
exclusively for nonpaying guests. No such
guesthouse shall be used for purposes of
permanent residence not be rented or sold
separately from the principal
dwelling.
- Temporary real
estate signs, all such signs subject to
the provisions of Section
8.02.
- Uses and
structures customarily associated with
and directly incidental to the uses and
structures permitted by special exception
only after such special exception shall
have been granted by the Board of
Appeals.
- Temporary
buildings, and structures incidental to
construction, which shall be removed upon
completion or abandonment of the
construction work.

23.00 - Statement of Intent
It is the intent hereof that the
"C-2" district shall provide for
certain types of commercial uses which are
directly related to highway or street
activity and which customarily are located
adjacent to major streets or roads.
23.01 - Permitted Principal Uses and
Structures
The following principal uses and
structures shall be permitted in the
"C-2" district:
- Gasoline
sales.
- Sale of snacks,
soft drinks, and miscellaneous items,
such use not to exceed 600 square feet of
gross floor area.
- Service and minor
repair of motor vehicles.
- Public
information and event signs, subject to
the provisions of Section
8.02.
- Auction
galleries.
- Uses and
structures permitted in the
"C-1" district.
23.02 - Special
Exceptions
The following principal uses and
structures may be permitted by special
exception in the "C-2"
district:
- Major repair of
motor vehicles.
- Sale of motor
vehicles.
- Utilities, other
than essential services as defined in
Section 7.00.
- Additional
permitted uses on a conforming or valid
existing non-conforming lot.
23.03 - Accessory
Uses and Structures
The following accessory uses and
structures shall be permitted in the
"C-2" district:
- Uses and
structures customarily associated with
and directly incidental to the permitted
principal uses and
structures.
- Uses and
structures customarily associated with

The intent hereof is that the
"C-1" district shall be used to
provide for general localized commercial
services, and shall not include large scale
commercial activities, nor include highway
oriented commercial activities.
22.01 - Permitted Principal Uses and
Structures.
The following principal uses and
structures shall be permitted in the
"C-1" district:
- All of the principal uses and
structures permitted in the
"R-2"
district.
- Antique shops, providing that no
such use shall exceed 3,000 square feet
of gross floor area.
- Art shops, providing that no such
use shall exceed 3,000 square feet of
gross floor area.
- Grocery or food store, providing
that no such use shall exceed 3,000
square feet of gross floor
area.
- Beauty shop, providing that no
such use shall exceed 3,000 square feet
of gross floor area.
- Florist shop, providing that no
such use shall exceed 3,000 square feet
of gross floor area.
- General dry goods and/or hardware
store, providing that no such use shall
exceed 3,000 square feet of gross floor
area.
- Gift shop, book shop, providing
that no such use shall exceed 3,000
square feet of gross floor
area.
- Pharmacy, providing that no such
use shall exceed 3,000 square feet of
gross floor area.
- Shoe repair shop, providing that
no such use shall exceed 3,000 square
feet of gross floor
area.
- Taxidermy business, providing
that no such use shall exceed 3,000
square feet of gross floor
area.
- Upholstery shop, providing that

structures may be permitted by special
exception in the "C-1"
district:
- All uses and structures listed in
Section 22.01, but providing that such
businesses may have greater than 3,000
square feet of gross floor area but no
greater than 10,000 square feet of gross
floor area.
- Bakery, providing that no such
use shall occupy greater than 10,000
square feet of gross floor
area.
- Business offices, providing that
no such use shall occupy greater than
10,000 square feet of floor
area.
- Dry cleaning, providing that no
such use shall occupy greater than 10,000
square feet of gross floor
area.
- Restaurants and food carry-out
establishments, not including drive-in
type eating places, providing that no
such use shall occupy greater than 10,000
square feet of gross floor
area.
- Funeral establishments and
chapels, providing that no such use shall
occupy greater than 10,000 square feet of
gross floor area.
- Farm implement sales, providing
that no such use shall occupy greater
than 10,000 square feet of gross floor
area.
- Automobile and farm equipment
repair and service establishments,
providing that no such use shall occupy
greater than 10,000 square feet of gross
floor area.
- Hotel, providing that no such use
shall occupy greater than 10,000 square
feet of gross floor
area.
- Newspaper and print shop,
providing that no such use shall occupy
greater than 10,000 square feet of gross
floor area.
- Building supplies and warehousing
of building supplies, providing that no
such use shall occupy greater than 10,000
square feet of gross floor
area.
- Frozen food lockers, providing
that no such use shall occupy greater
than 10,000 square feet of gross floor
area.
- Commercial swimming pool,
providing that no such use shall occupy
greater than 10,000 square feet of gross
floor area.
- Commercial greenhouses, providing
that no such use shall occupy greater
than 10,000 square feet of gross floor
area.
- Rest homes, nursing homes, or
other institutions for human care of the
treatment of noncontagious diseases,
providing that no such use shall occupy
greater than 10,000 square feet of gross
floor area.
- Utilities, other than essential
services as defined in Section
7.00.
- Off sale alcoholic
beverages.
- Additional permitted uses on a
conforming or valid existing
non-conforming lot of
record.

"R-2" RESIDENTIAL DISTRICT

21.00 - Statement of Intent.
The intent hereof is that the
"R-2" district shall provide land
for moderate density multifamily
residential uses and certain other uses and
structures which are compatible
therewith.
21.01 - Permitted Principal Uses and
Structures.
The following principal uses and
structures shall be permitted in the
"R-2" district:
- The same
permitted principal uses and structures
as for the "R-1"
district.
- Duplex
dwellings.

- Town
houses.
- Garden type
apartments.

Condominiums.
21.02 - Special
Exceptions.
The same principal uses and structures may
be allowed by special exception as for the
"R-1" district.
21.03 - Accessory Uses and
Structures.
The following accessory uses and
structures shall be permitted in the
"R-2" district:
- Private garages,
parking areas, and other customary
residential outbuildings and
structures.
- Customary
incidental home or farm occupations
providing that all home occupations shall
require a permit from the Town Council.
Such permits shall be for three years,
and may be renewed by the Town
Council.
- Signs advertising
home occupations, subject to the
provisions of Section 8.02.
- Farm signs,
subject to the provisions of Section
8.02.
- Temporary real
estate signs, subject to the provisions
of Section 8.02.
- Temporary
buildings and structures incidental to
construction work which shall be removed
upon completion or abandonment of the
construction work.
- Generally, uses
and structures customarily associated
with and directly incidental to the
permitted principal uses and
structures.
- Uses and
structures customarily associated with
the directly incidental to the uses and
structures permitted by special exception
only after such special exception shall
have been granted by the Board of
Appeals.
The following
provisions shall apply to accessory
structures.
- Accessory
structures shall be located only in a
rear yard or side yard, except for signs
allowed herein.
- No accessory
structure or part thereof shall be
located less than eight feet from any
side lot line, except that on corner lots
no such structure shall be located less
than 15 feet from the edge of the street
pavement.

It is the intent hereof that this district
shall provide for the continued development
of certain subdivisions at higher density
than allowed in the "R-1" district
where said subdivisions were approved before
the implementation of this ordinance and have
remained partly undeveloped.
20.01A - Requirements, Regulations,
Permitted Uses, and Special
Exceptions.
All "R-1" residential district
regulations shall apply to the
"R-3" district except the minimum
side yard width shall be eight feet and the
minimum front yard depth which shall be
twenty-five feet from a Town street, fifty
feet from a State road and one hundred fifty
feet from Route 50 (see also
26.08).
