HOW TO FILE A
ZONING APPEAL
The appeal process is costly and time consuming. The application fee is currently $50.00 and the appeal must be heard at an advertised public hearing. Before filing an appeal, consider these points.
  • Could the plans be changed so that an appeal would not be needed? The board will be less likely to approve an appeal if reasonable alternatives exist.
  • Will the appeal be for a special exception, variance, or administrative review? One should not request a variance if the desired use is allowed with a special exception.
  • Does the proposed appeal stand a reasonable chance of being approved? That can be a difficult question to answer. The applicant may want to seek professional advice.
  • Do the neighbors approve of the proposed application? The board will carefully consider any objections presented by nearby residents.
The applicant should be prepared to show that the appeal meets all of the legal requirements for consideration, under the terms of the Trappe Zoning Ordinance, and that granting the appeal will not have an adverse effect of the neighborhood, or violate the intent of the Zoning Ordinance.
