Ordinance 4-2003 Open Space

The Public Hearing was opened at 7:15 p.m. by President Cheryl Lewis on Ordinance 4-2003 Open Space. Vice President Bob Niemeyer and Commissioners Edgar Harrison, Danny Adams and Norm Fegel were present.

Commissioner Harrison introduced the Ordinance.

An Ordinance of the Town of Trappe amending the Town subdivision Ordinance enacted on July 3, 2002 by adding the definition of “Common Open Space” and amending section 42 of the subdivision ordinance by adding provisions relating to common open space.

Mr. Paul Moore said that it was his understanding that in fee in- lieu of open space as a dedication on subdivisions, he was wondering if this was going to be changed, since this would definitely affect his subdivision of only ten lots. Com Harrison read:

The Town Council may permit fee in-lieu of dedication of common open space when the applicant cannot adequately meet the common open space requirements outlined herein or if the development if less than 20 homes or within 1,500 feet from an existing park or playground. The fee in-lieu shall be on a per-dwelling-unit basis as established by the Town of Trappe. He answered Yes to Mr. Moore’s question.

The public hearing was closed at 7:20 p.m. with no other response.

TOWN MEETING MINUTES
August 6, 2003, 7:30 p.m.
Trappe Town Hall


The regular Town meeting was opened by President Cheryl Lewis and called to order at 7:30 p.m., Vice President Bob Niemeyer and Commissioners Edgar Harrison, Danny Adams and Norm Fegel were present. Everyone stood and recited the Pledge of Allegiance. The July minutes were accepted as amended. The July Financial Statement was accepted as presented.

Executive Session – July 21, 2003

There was an Executive Session on July 21, 2003 at 7:00 p.m. Council members present were: Cheryl Lewis, Edgar Harrison, Bob Niemeyer and Norm Fegel. The meeting was on personnel issues.

Executive Session – August 6, 2003

There was an Executive Session after the meeting on August 6, 2003 at 8:15 p.m. Council members present were: Cheryl Lewis, Edgar Harrison, Bob Niemeyer, Norm Fegel and Danny Adams.

Brynja Booth and Dave Thompson Attorneys.

The meeting was to discuss personnel issues.

Regular Session

Commissioner Harrison introduced Mr. Frank Hall as full time employee of the Town of Trappe effective September 2, 2003. His primary duties and expertise will be planning and he has had experience in grant writing. The Council welcomed him aboard.

OLD BUSINESS: President Lewis read Ordinance 4-2003

AN ORDINANCE OF THE TOWN OF TRAPPE AMENDING THE TOWN SUBDIVISION ORDINANCE ENACTED ON JULY 3, 2002 BY ADDING THE DEFINITION OF “COMMON OPEN SPACE” AND AMENDING SECTION 42 OF THE SUBDIVISION ORDINANCE BY ADDING PROVISIONS RELATING TO COMMON OPEN SPACE.

She added that we have just had a public hearing on this Ordinance 4-2003 at 7:15 p.m. and we had one question that was answered.

Motion was made by Com. Harrison to accept the Amendment Ordinance 4-2003. Motion was seconded by Bob Niemeyer.

Vote: Adams – Y, Lewis – Y, Harrison – Y, Niemeyer – Y, Fegel – Y.

CHLORINATION WORKSHOP:

President Lewis stated that the Council held a workshop on chlorination and would like to give you the results. This was about the chlorine gas used at the wastewater treatment plant and the water system . We have come up with a dual solution consisting of changing the water supply system to a liquid bleach disinfection, which would be safer to handle, and using ultra violet disinfection at the sewer system. Mr. Croswell was given the authority to start on the liquid bleach system and the town engineers will set up a test for the ultra violet system.

TOWN WEB SITE:

President Lewis announced that someone else was now doing our Town web site. Commissioner Harrison thanked Mr. Croswell for establishing our web site he extended appreciation for all of the time he has spent. There will be no real changes it will stay basically the same as it has been.

NEWSLETTER:

We will now be doing a monthly newsletter in with the water bills. Ms. Anne Dorbin will be getting it together with information from each meeting to be added.

STORM WATER: Attorney Booth stated that State Law requires that we adopt a Storm water Ordinance. We have had a draft before us to look over and to think about. We also had a workshop on June 16, 2003. The Ordinance is similar to the County’s, we have made some changes and we are putting it before you tonight to introduce Storm Water Ordinance 5-2003.

President Lewis read: Ordinance 5-2003

AN ORDINANCE OF THE TOWN OF TRAPPE ADOPTING A STORM WATER MANAGEMENT ORDINANCE, PURSUANT TO THE ANNOTATED CODE OF MARYLAND, ENVIRONMENTAL ARTICLE, TITLE FOUR, SUBTITLE TWO.

Com. Harrison said we will give to the Boca Appeals Board and they can review; then we will have a public hearing.

Public Hearing is on September 3, 2003 at 7:00 on STORM WATER MANAGEMENT - ORDINANCE 5-2003.

I & I

Commissioner Harrison said that we need to address the I & I situation. He stated that Mr. Croswell had Tri State to review. It seems the manholes are a lot of the problem. We can have this done and pay $19,500. this year and the balance to follow next year, or we can have it all done for $31,000.00 this year. It was stated that the longer we wait the more work will need to be done. President Lewis suggested that we have it all done and just pay the $31,000.00 this year. We should have the smoke test done also.

Motion was made by Com. Adams to approve the money, pending on when they can do the work. Seconded by Com. Harrison.

NEW BUSINESS:

ATTORNEY BOOTH:

Proposed amendments to the Trappe Zoning Ordinance to implement the planned development recommendations of the Comprehensive Plan.

Attorney Booth stated that the Planning Commission has recommended this Ordinance to the Council.

COM. HARRISON ORDINANCE 6-2003

Com. Harrison stated that the Planning Commission introduce Ordinance 6-2003 with some amendments that are included.

AN ORDINANCE OF THE TOWN OF TRAPPE REPEALING AND REENACTING SECTION 14 OF THE ZONING ORDINANCE RELATING TO FEES, CHARGES AND EXPENSES, AND REPEALING AND REENACTING SECTION 15 OF THE ZONING ORDNANCE RELATING TO THE ZONING ORDINANCE AMENDMENT PROCEDURE, AND AMENDING THE ZONING ORDINANCE TO CREATE SECTION 30 ENTITLED “FLOATING ZONES”.

It was stated the PUD has now changed name to floating zones, enabling legislation to create floating zones.
